Winnie loses bid to claim Nelson Mandela’s house

WINNIE Madikizela-Mandela’s bid to claim Nelson Mandela’s Qunu home as her home has failed!

The Mthatha High Court dismissed her arguments that the home was rightfully hers.

Madikizela-Mandela brought the case in 2014 after her ex-husband’s will left the home to the Nelson Rholihlahla Mandela Family Trust for the benefit of the Mandela family. This includes her third wife Graça Machel and her two kids.

Madikizela-Mandela based her claim on two arguments. One was that the property was given to her by the tribal authority while Mandela was still in prison.

The other was that she wasn’t actually properly divorced from Mandela. Only the civil union between them was dissolved by divorce. Through their customary marriage, they were actually still man and wife.

The court rejected her claims and dismissed the case with costs.

In a statement, the royal family of the Kingdom of AbaThembu welcomed the judgement. It said that Madikizela-Mandela should not have followed the court route to solve the problem, but should have referred to the customary structures instead.

It said: “We believe that Nkosikazi Nobandla Winnie Madikizela-Mandela Mandela was mislead by some members of the family. We further believe that she did not receive a legal advise she mostly required.”
